The RoleThe RoleTo provide specialized legal input to Counsel – Legal and Counsel – Associate, related to construction contracts facilitating management decision making. Actively involve and advice during the Pre Contractual, Contract Negotiation and Post Contract processes, minimizing risk exposure and protecting interests of the company. Provide construction legal input and assist and support the Counsel - Legal and Counsel - Associate to assess the risk of entering into contracts in order to ensure that the company is, so far as practical, not exposed to uncontrolled risk. Provide input as part of the tendering / contract award process in order to take steps to ensure that the correct terms and conditions are used (or if not available, are created). Negotiate and where relevant, assist and support the Counsel - Legal and Associate Legal to negotiate various types of construction related contracts with a view to finalising contracts and, so far as practical, protecting the interests of the company. Draft and review and where relevant, assist and support the Counsel - Legal and Counsel - Associate to draft, review, and negotiate various construction related contracts related to the business of the company and its subsidiaries with a view to preventing legal exposure, so far as practical, and evaluating risks. Provide advice on an ongoing basis in relation to interpreting existing contracts and any legal issues arising in relation to implementation of contracts. Assist in standardisation of construction contracts / related business terms. Assist in providing appropriate revisions from time to time to such standard forms, and review all non-standard construction related contracts and deviations there from with approved limits (to be agreed by and with the Counsel - Legal and Counsel - Associate). |
RequirementsRequirementsMinimum Qualifications: Bachelor degree in Law from a reputable university. Knowledge of local laws and regulations and the business environment. Experience in Property and Construction law. In depth knowledge of FIDIC forms of contract. Minimum Experience: At least 8 years of legal experience in a commercial environment, preferably at least 6 years advising in relation to real estate and construction industry. |
