Job description / Role

Employment: Full Time

Manage timely and effective contracting and contract administration activities at assigned project site, ensuring compliance to QPM contracting policies and procedures and ensuring effective monitoring contract of terms and conditions for all external parties involved at all stages of a project.
- Support procurement engineer in package and bids preparation.
- Coordinate all contractual activities including contract drafting, vendor meetings, contracts negotiations and finalizations on behalf of the client.
- Review contract documents for accuracy and appropriateness.
- Coordinate with procurement engineer to finalize contract terms with consultants, contractors and other parties.
- Clarify client doubts and advise clients on finalization of contract terms and conditions.
- Coordinate warranties, performance bonds and insurance and ensure that they are in place in accordance with the main contract and any subcontract conditions.
- Advise on alternative and most suitable procurement strategies
- Interpret contracts and assist project team in its application.
- Monitor key dates against dates defined in the main contract and any subcontracts which are aligned with project management plan.
- Prepare contract supplements.
- Coordinate / facilitate / attend meetings concerning contracts progress, and various technical contractual matters.
- Ensure that notices and certificates are issued and received in accordance with the main contract and subcontracts.
- Ensure that clear and accurate records of contractual matters are maintained.
- Coordinate with project teams to ensure proper validation of contractors bills etc. against work done.
- Review and advise client on problem areas together with identification of any changes/additions/deletions to the contract during the project.
- Ensure contractor submissions and compliance with Contract terms and conditions
- Advise on any deviations from the Contract and possible risk exposure to the client
- Use QPM standard tools and templates for onsite contracts management.
- Ensure appropriate filing and maintenance of key contracts documentation.
- Support Manager Contracts to review contracts administration reports from site by providing timely reports.
- Seek advice on remedial actions on contract administration issues as required.
- Work with Legal Counsel to advice client and address claims and other contractual issues arising out of porject on behalf of client.
- Oversee and support legal action on behalf of client in cases of legal disputes with consultants and contractors.
- Advise project team on compliance to the contract and other contractual matters during the course of the project.
- Advise and closely support the Contacts Manager on claims avoidance and defense

Requirements

Graduate in Engineering or BS, in Quantity Surveying with some ADR experience
Membership of Chartered Institute of Arbitrators or similar with minimum 8 years experience in the construction industry of which at least 4 should be as Contracts Engineer
- Contracts law
- Construction sector laws in GCC and globally
- Tendering, bidding and contracting (and contract administration)
- FIDIC, JCT, NEC etc
- Construction contracts (FFP, FP-EPA, CPIF, CPFF etc)
- Claims preventions.
- EDT and cost claims review and analysis experience would be advantageous
- An understanding of the Arbitration and ADR process would be advantageous
