Job description / Role

Employment: Full Time

With a fast paced expansion plan set for the year 2015, we are currently looking for Contracts Manager for our Corporate Office in Qatar. You will be responsible for the formation, management, administration, and review of all forms of contract agreements, including MoUs, Pre-Bid Agreements, Teaming Agreements, Confidentiality Agreements, Prime Contracts, and Subcontracts.

The candidate would be mainly responsible for leading the following three areas:

- Pre-Award - review of contract terms and conditions associated with incoming pre-qualifications and invitations to tender, with a view of identifying risks associated with the opportunity. As required, lead the procurement of subcontractors in accordance with Companys policy. In coordination with Legal, develop and/or review any form of pre-bid MoU or form of contract/subcontract agreement; in accordance with Company policy, secure requisite bonding and insurance, and ensure requirements are cascaded down to subcontractors, as required. Participate in prime contract and subcontract negotiations with a view of spearheading conforming of contracts/subcontracts.

- Post-Award - Manage and monitor project compliance with prime contract terms and conditions, and maintain the project baseline; review of project financial data in order to ensure awareness of all project activities associated with the prime contract. Identification of opportunities for revenue enhancement, schedule relief, and claims avoidance; implementation of appropriate actions to protect project interests and improve project performance. Provide operational supervision and technical guidance to contracts/commercial staff and other project personnel supporting contracts or claims activities; ensure prime contract provisions are flowed down to subcontracts. Development and management of a Prime Contract Change Management Procedure, which defines a process for identifying changes, quantifying commercial impacts, defining approval requirements, and demonstrates how to effectively transmit changes to the Client; preparation of variation orders or amendments to the prime contract. Development of negotiation strategies, and support management during prime contract negotiations; Reparation and presentation of commercial and technical recommendations to the Client; identification of Client related actions or inaction's which may result in constructive contract changes, and recommend actions to be implemented; identification of areas of risk due to ambiguities, omissions, and conflicts in the contents of the documents relative to the prime contract. Development and administration of risk mitigation plan; ensure contract insurance provisions are adhered to and coordinate with management regarding occurrences which may be covered by either Client or Company furnished insurance.

- Subcontracts - Manage and monitor Subcontractor performance with respect to obligations pursuant to the terms set out in the subcontract agreement; advising management of Subcontractor activities affecting prime contract rights and obligations. Maintaining a continual review of Subcontractor progress and providing management with information regarding projected financial or technical difficulties resulting from subcontract changes and claims; resolution of complex subcontract change requests. Negotiation and settlement of complex subcontract changes; checking relevant staff CVs and ensure compliance with the subcontract requirements; Initiate/coordinate all correspondence relevant to the foregoing duties addressed to/received from the Subcontractor; manage administer processing of payments; monitor and review cash flow forecast on a regular basis and inform management accordingly review Subcontractors proposed deployment schedule to ensure compliance with Subcontract requirements; Monitor and review valuation of variations and ensure timely completion of Final Accounts and Close-Out of Project.

Requirements

- Minimum qualification of a Bachelors degree in the field of Engineering with experience in large complex infrastructure projects, involving Project Management and Design.
- Minimum period of 15 years work experience in a senior contracts/commercial position on large complex infrastructure projects.

Preferred criteria
- Strong administrative capabilities and managerial skills.
- Self-innovated, a leader, and able to work under no supervision in a heavy workload environment. This will be beside a quality sense of defining management and administrative problems, collecting appropriate and related data to establish solutions.
- Advanced knowledge of civil / construction industry practices, industry standards, and FIDIC based contracts.
- Above average communication and computer literacy skills (MS Office Suite).
- Middle East experience preferred.
- Multinational Consultancy Firm background.
- Must have the full capability to read, analyze, write and interpret contracts, together with technical and legal documents in the English language. Fluency in Arabic also an asset.
- Ability to define problems collects data, establish facts, and draw valid conclusions. Ability to interpret extensive variety instructions and deal with several abstract and concrete variables.
