Job description / Role

Employment: Full Time

The post holder will be responsible for supporting the HOL in the provision and management of the litigation and dispute resolution issues involving CBI and its subsidiaries or affiliated companies (the Group). The post holder will support the HOL in leading a team of litigation staff and ensure that best practice is adopted with regard to the management of the litigation services.

Duties and Responsibilities:

a) In conjunction with the HOL, develop, implement and review processes, systems, policies and procedures for the effective and efficient management of litigation cases.

b) Assist in the day to day to the management of litigation cases in accordance with Banks Policy and Procedure.

c) Alongside the HOL, act as the point of contact with the external advocates and Legal Advisors regarding litigation cases and general legal queries.

d) To assist in the analysis of the outcome of the cases investigations and interpret, in conjunction with the Banks solicitors as required, the range of available options opens to the Group.

e) Responsible for the maintenance of the content on the cases database in accordance with the Groups policy and procedure. Provision of regular and ad-hoc reporting to senior management.

f) Liaise with appropriate staff in respect of all aspects of litigation cases.

g) Assist in the management and review of systems to ensure the prompt provision of discoverable documents and the investigation of claims to enable the Group and its legal advisors or advocates to assess liability, quantum and the defense of cases.

h) Investigate and assess legal liability in respect of individual cases. This involves gathering and considering relevant information (including detailed confidential documentation).

i) Ensure that the HOL and appropriate staff are informed of new cases and kept informed, on a regular basis, of the progress of the investigation of these cases.

j) In conjunction with the Groups legal advisors and advocates attend consultations with Counsel and staff in preparing for a court hearing and ensure all necessary follow up action is taken, as necessary or required by the HOL.

k) Take detailed notes of evidence for use in the Groups defense of cases.

l) Provide in-house legal support and guidance to staff requested to attend Court.

m) Responsible for the planning and delivery of training to staff in respect of the management of cases.

n) Attend Court, arbitration tribunal and expert meetings, as required, and to liaise with Groups respective Counsel and the Groups respective legal advisors in relation to settlement of litigation cases.

o) To provide information, advice, guidance and support at an appropriate level to staff, relevant to litigation services.

p) Assist HOL in the preparation of reports and briefings as appropriate for Board/ individual Directors on litigation cases.

q) Assist HOL in the preparation of presentations/ reports at interface Governance meetings in order to ensure the sharing of lessons learned from litigation cases with relevant Directorates in line with Bank processes.

r) Provide timely legal advice regarding litigation cases in writing and in person in relation to specific cases. If required by HOL, provide timely legal opinions and advices as well as draft and review legal documents in support of the legal affairs of the Group.

s) Perform any other duties or responsibilities consistent with the role as assigned by the HOL or the management.

Requirements

Education:
Bachelor's degree in Law.

Professional/ Technical Qualifications/ Diplomas:
None specific.

Experience:
Minimum 10 years legal experience of which at least 5 years should be with a reputed law firm or the legal department of a financial institution.

Other Skills Required for the Job:
Knowledge and experience with Company Law/ UAE Laws, Judgments (Courts) and Doctrines.
Track records of handling variety of legal matters and recovery of debts.
High proficiency verbal and communication skills in Arabic and English.
Negotiation skills to deal with customers for out of court settlements.
PC skills (MS Office, Internet).
Planning and organizing skills.
Analysis and documentation skills.
Managerial and leadership skills.
Interpersonal/ communication skills.
