Contract Development Manager - Success Profile

Key purpose

- Responsible for commercial contract agreements and activities within the Transport business unit from Gate 6 onwards (Start of Operations).
- Ensure commercial standards, procedures and processes are applied across all operational commercial activities within Transport projects.
- Ensure contract compliance with respect to company secretarial, insurance and treasury policies.
- Ensure contract commercial compliance from a delivery perspective including independent reviews and verifications.
- Provide commercial advice and guidance to the management team and contract delivery teams.
- Provide contract education and training at site level.
- Responsible for managing all operational commercial activities and solutions including: contract document management, contract performance management, contract change management, contract growth/scope management, customer contract negotiations and commercial documentation and correct filing.
- Determine & drive commercial contract improvement initiatives including managing the impact of contract performance and abatement regime on pricing and profitability; developing mechanisms to improve profitability and reduce penalties.
- Ensure post investment reviews are undertaken for all projects and lessons learnt are captured in next appropriate project.
- Undertake contract performance and compliance reviews for all projects on a regular basis.
- Manage issues, claims and dispute resolution.
- Deliver commercial reporting to satisfy Business Unit and Divisional objectives.
- Engage and work with internal/external legal counsel as appropriate.
- Manages the contract's relief, compensation, force majeure event procedures.
- Protect information assets and data including both electronic and paper based from all threats whether internal, external, deliberate or accidental;

Structure and reporting relationship

- BAU (post gate 6) commercial / contracts reporting into the Senior Commercial and Contracts Manager.

Based on the specific requirement of the role

Key accountabilities

- Ensure commercial risks and opportunities are identified and mitigated/managed.
- Ensure that the company's risk, liability and ultimately margin position in the contracts is preserved on an ongoing basis.
- Ensure that scope creep and working at risk in minimized as much as possible and correct policy and procedures are followed in all instances, for example the variation process.
- Ensure that the company's commercial and procurement governance policies and practices are adhered to by the teams delivering the projects.
- Support the project delivery team in adhering to and managing all obligations contained within the contracts.

Requirements

Essential technical and professional skills , knowledge and qualifications

Knowledge

- Relevant degree or professional qualification in relation to commercial / contracts management, as appropriate.
- High level knowledge, understanding and demonstrable experience in managing commercial contracts post signature within an outsourcing or equivalent environment.
- Strong technical grasp of commercial activities including managing and negotiating contractual change.
- Ability to draft, interpret and communicate contractual terms and concepts in a legal / contractual setting.
- Strong technical understanding of the underpinning conceptual elements of contracts, including such terms and conditions as termination, penalties / damages, insurances, liabilities, change control, relief and compensation regimes, invoicing, intellectual property, confidentiality, etc.
- Good knowledge of regulatory and legal frameworks and systems that impact commercial contracting.
- Strong and demonstrable skills of working within a multi-disciplinary team with numerous internal and external stakeholders.
- Operational support experience (outsourcing, BPO, transport, O&M type contracts).

Experience

- At least 7+ years commercial experience in relevant industries and organisations.
- Significant commercial operational experience incorporating responsibility for both financial and contractual commercial outcomes and risk management.
- Experience in the reviewing, drafting and negotiating customer / contractor / service provider contracts and pricing.
- Proven experience in delivering commercial improvements on contracts.
- Experience in working with and leading a multi-disciplinary / multi-national team.
- Significant experience in management of contracts and/or sub-contracts.
- Experience in business growth success and the bidding/tendering process.
- Project or general management experience desirable.
- Proven experience in stakeholder management and the development and management of senior level relationships in government and business in a highly competitive environment.
- Middle East experience.
