JOB DESCRIPTION / ROLE

Job Description

To protect KEC’s contractual interests and with the government entities, partners and service companies which eventually should reduce legal exposure, conflicts and litigations.
Coordinate all aspects of the contract process including tightly managing commitments, ensuring compliance, negotiating amendments and agreeing to contractor’s claims for adjustments
The scope of this role demands extensive knowledge of contract law, excellent analytical, problem solving, influencing and communication skills and the ability to structure and close complex high value agreements. Equally, superior presentation skills, knowledge of C&P tools and techniques, complete understanding of HSSE requirements, experience in mega projects, natural versatility and the abilities to identify risk, think strategically, motivate peers and work independently are crucial.
Run a team of experienced contracts, procurement and warehouse specialists.
Maintain good relations with contractors and materials/service providers.
Maintain good relations with Local authorities.
Ensure the procurement of works, materials and/or services complies with corporate policies and regulations and specifically in accordance with the requirements/parameters and procedures as described in the KEC regulations to achieve function objectives and to achieve optimum value for money.
Generate contracting and tendering strategies/plans to achieve the objectives of the end user's functional needs.


Propose and justify an appropriate bid strategy and thereafter execute the approved strategy.
Assist the end user to identify suitable bidders for each proposed tender.
Coordinating pre-bid meetings, site visits and clarification requests. Where necessary liaise with legal, finance and insurance functions and provide responses to bidders’ contractual clarification requests.
Handling bids in accordance with the KEC contracts regulations and policies.
Participate in bid evaluations.
Prepare award recommendation proposal in conjunction with the bid evaluation team.
Ensure complete records are produced and files kept which reflect a clear and complete audit trail of each procurement exercise.
Produce procurement activity and status reports.
Generate other reports as required by the Senior Management.
Identify risks and provide solutions to negate these.
Maintain the highest level of integrity in accordance with the Contracts procedures.
Perform work as Instructed by the Senior Management.
Demonstrated knowledge of commercial practices and legal principles.
Experience in review, analysis, defense, etc. distinguishing contractor's claims.
Experience in developing contract types, fee arrangements and contract terms.
Experience in developing and recommending potential solutions to contractual problems to management.

Work with Country Managers, Product Line Managers and Tenders Team to improve the efficiency and quality of contract, tender submissions, pre-qualifications, client questionnaires and to monitor progress and performance of such where appropriate.
Discuss and negotiate contractual exceptions with the bidders to ensure that the Company is entering into Contracts that adequately address the risk and reward equation in business.
Attend managers meetings to keep other members of the management team up-to-date with the latest issues in the Commercial department.
Provide guidance and direction to Contracts Administrators to ensure the administration of the department is working efficiently.
Liaise with Legal Counsel and other members of the legal team to ensure continuity in legal reviews and corresponding comments. Seek direction from the Corporate Legal Team on specific critical issues.

REQUIREMENTS

Experience, Skills and Qualifications Required:

B.Sc in Engineering
More than 12 years experience in similar position and in the E&P sector.
Demonstrated written and verbal communication skills.
Demonstrated experience in warehouse Management and Inventory Management systems.
Demonstrated knowledge of commercial practices and legal principles.
Experience in review, analysis, defense, etc. distinguishing contractor's claims.
Experience in developing contract types, fee arrangements and contract terms.
Experience in developing and recommending potential solutions to contractual problems to management.
