JOB DESCRIPTION / ROLE

Employment: Full Time

Purpose:
To lead all commercial aspects of the MME business; develop and deploy innovative financially advantageous commercial solutions; minimise the risk profile of MME through leadership and governance of all commercial and legal activities during the lifecycle of any bid or contract award; develop and enhance commercial skills and culture throughout the operational business and own team through development of training and other supporting activities.

Principal Accountabilities:
• Supporting opportunities, the commercial solutions and leading commercial, financial and contract development work streams, through to financial close and award.
• Leading all aspects of support and governance of bid opportunities across the MME business, ensuring compliance with bid processes and that innovative and financially advantageous commercial solution are developed and included in bid submissions.
• Ensuring commercial handover, from bid to operational delivery, is communicated and understood, immediately after award of tenders including providing support during mobilisation and initial operational delivery phases as appropriate including project start-up requirements.
• Being the practical and professional senior person responsible for all pre-contract commercial and legal escalation issues. This will require liaison with the operating business to reach agreements on escalated matters such as liability limits, bid/no bid decisions, Group support requests, and deal structure matters through to all commercial contracts across MME including registrations.
• Motivating and developing employees across the business to improve quality and consistency of commercial performance and match the demands of the business strategically going forward as well as day to day. This will involve giving personal technical advice and leadership and providing support and structure for the team to learn from each other. As the MME business grows sourcing and integrating new team members to the commercial community to strengthen the competency and sustainability of the team.
• Supporting the raising of commercial awareness and performance within all operational and business development teams. This will involve liaison with the operating business (including HR) to support performance reviews, development and delivery of training and other activities such as providing of case studies and ensuring appropriate compliance disciplines and consequences for non-compliance of mandatory requirements.
• Providing strategic commercial management through the implementation of appropriate and effective controls and policies to minimise risk to the Business. Co-ordinate and manage commercial and legal resources to provide effective support across the Business and optimise external legal spend. This will involve using relationships built with the operational business and commercial team, to prioritise and reprioritise demands for commercial services to best support the needs of the Business. This will also involve co-ordination and consultation with the MME CMT to ensure alignment and consistency where appropriate.
• Be an active member of the Mouchel Infrastructure Services Commercial and Development team, contributing to strategy and policy, decision making and direction; identifying, sponsoring and delivering business improvement opportunities; and contributing to the development of an enhanced commercial culture in the business.

• Understand the risk profile of the Business and ensure this is reviewed and reported to the MME & Mouchel Infrastructure Services Board.

REQUIREMENTS

Qualifications:
Qualified Commercial Practitioner with significant experience in contract and commercial law, and significant experience in operational management and financial structuring of opportunities.
Chartered Member of the Royal Institution of Chartered Surveyors (MRICS).

Knowledge/Experience:
Fifteen plus years experience in operations in a consulting environment.
Middle East experience is essential
Must be contractually legally proficient and able to converse, effectively challenge and manage lawyers and gain external credibility with customers and customer legal advisors for legal proficiency.
Must have experience of improved cost effective methods to increase profitability and competitiveness, and of negotiation of arrangements with supply chain sub-contractors and suppliers including risk transfer as appropriate.
Has a network of internal and external contacts to ensure commercial knowledge is topical, and uses systems to gather and analyse business intelligence and market information to inform tender pricing strategies.
Implementation, development, co-ordination and training of commercial skills and culture is highly desirable.
