Summary Description
Provide support to the Claims Manager for all PMC activities relative to Contractor claims including but not limited conducting interviews with concerned PMC personnel; Identification, evaluation and compilation of all key records and facts from all available sources that are necessary to evaluate all parties’ contractual and legal entitlement. Perform tasks assigned by the Claims Manager including but not limited to generation of contractually required claims responses, oversight of forensic evaluations, assisting the Clams Manager to ensure that robust contractual, factual and commercial input is considered in developing claims resolution strategies, client defense strategies and coordination of cost and delay analysis and quantum evaluation.

Role and Responsibilities

Assist the Claims Manager in the claims and dispute resolution process on behalf of the client for all tasks relative to claims assigned by the Claims Manager including but not limited to:

Provide assistance in the forensic analysis, evaluation and resolution of assigned active claims
• Evaluation of both contractual and legal entitlement
• Identify, collect and evaluate relevant facts and records
• Carry out all research assignments assigned by the Claims Manager
• Collate related information and provide analysis based on facts, records and the contract
• Assist Claims Manager in developing and submitting Requests for Engineer’s Determinations
• Assist Claims Manager in all aspects of claim resolution, defenses and counter-claims
• Prepare reports and recommendations related to claims and disputes

Provide assistance in the assessment process for all elements of assigned claims
• Liaise with PMC planning staff regarding appropriate methods of delay and program analysis and dissection of construction programme(s) for the purposes of assessing entitlements
• Liaise with PMC cost staff regarding appropriate methods of cost evaluation for the purpose of assessing entitlements

Maintain/update all data and information recording and reporting requirements in accordance with the Client Claims Management Procedure and all Practice notes including but not limited to the Claims Register and Contract Management and Information System (CMIS)

Maintain/update all data and information recording and reporting requirements established at the Site level including but not limited to the Claims Progression Matrix and Claims Assessment Summaries
• Produce well-written, concise reports and letters, with minimal revisions required for assigned claims
• Coordinate the input of the commercial view into the client’s decision making process around triggering disputes and/or litigation
• Compile required information and produce reports required by the Client
• Adhere to and maintain familiarity with any Client procedures regarding items such as Contract Administration, Claims Management, Employer’s Claims and Contractor’s Document Inspections
• Act for or on behalf of the Claims Manager when instructed
• Perform any other claims related tasks assigned to the Claims Administrator by the Claims Manager

Requirements

• Degree or substantial experience in construction and/or legal discipline or similar
• Minimum 8 years’ experience in the handling and management of claims and disputes on major infrastructure projects; less than 8 years’ experience may be considered if experience is significantly substantive
• Professional accreditation and membership of industry leading and internationally recognized institute(s)
• Extensive experience working with FIDIC suite of contracts
• Wide-ranging experience of roles and positions within the construction industry including roles with clients and contractors/subcontractors
