Overview:

We are looking to hire a senior contracts engineer for an oil and gas operator in Doha, Qatar.

Candidates must have a minimum of 12 yearsu2019 experience in project execution in the oil and gas industry as a contract engineer, handling EPC and engineering contracts.

Fluency in English is a must.

Key responsibilities

Pre-tender activities:

  • Review and advise on SORs and PINs (as applicable) at the inception of the project including advice on the best contracting strategy.
  • If the contracting strategy requires pre-qualified bidders, assist the sponsoring department (SD) in preparation of suitable tailor-made pre-qualification documents, invitations, and evaluation criteria and render expert advice to SDs in shortlisting potential bidders.
  • Obtain feedback from the legal and finance departments as required.
  • Assist SD in obtaining the committeeu2019s approval for the result of pre-qualification and contracting strategies.
  • Pre-contract: Tendering:

  • Provide professional advice, expertise, and practical assistance to all assigned end users/sponsoring departments of the corporation in the review and preparation of scopes of work, including verification of the accuracy of the technical information supplied.
  • Check anomalies or discrepancies, if any, in the tender document and ensure consistency throughout various sections of the tender document.
  • Identify the most suitable compensation mechanism for a given scope of work, i.e., lump sum, re-measurable, reimbursable, escalation factor, exchange fluctuations, etc., considering the intended contract duration and market conditions.
  • Provide expert advice and direction to the sponsoring department (SD) during tender preparation to ensure that the most suitable contracting strategy for a given scope of work is utilized.
  • Ensure RFQs meet client standards and risk assessment and risk mitigation measures are adequately identified, addressed, and managed by HSE risk management guidelines.
  • Ensure all work undertaken is consistent with client norms and values.
  • Ensure that tender bulletins are issued in a timely manner and capture the clarifications with adequate clarity.
  • Assist SD in facilitating bid explanation and clarification meetings, including required site observations where needed, to ensure bidders understand the scope of work.
  • Pre-contract: Tender evaluation:

  • Represent the contracts department in various tender and evaluation committees, including those of associates, affiliates, and joint ventures as and when required.
  • Maintain strict confidentiality and ethics on all contractual matters.
  • Ensure that a culture of "zero harm" is maintained.
  • Assume a lead role in commercial bid evaluations.
  • Ensure that bid evaluations are conducted fairly and ethically and are consistent with the terms and conditions of tenders, client policies and guidelines, and the evaluation criteria apply equitably to all received bids.
  • Lead the commercial evaluation team and prepare commercial evaluation reports and bid tabulation sheets.
  • Ensure that tender clarifications are issued in a timely manner and capture the clarifications with adequate clarity.
  • Lead in defining lower-level agreements for individual contracts, in alignment with a contracting strategy for the project.
  • During commercial negotiations of bidders with management, render practical assistance for effective negotiation including preparation of management briefs.
  • Ensure the security of pricing information and confidentiality of commercial evaluation.
  • Ensure bidders and contractors are set up in the SAP system.
  • Contract: Contract management:

  • Review various contract administration and contract management procedures to ensure compliance, where applicable, with client contracting policy and procedures and apply contractor management system.
  • Set up and maintain the goal of zero contractor claims and employ dispute avoidance techniques.
  • Attend monthly review meetings and obtain progress reports and minutes of progress meetings from sponsor departments; review and identify contract issues if any.
  • Monitor progress and performance of contractors.
  • Review work change requests to determine their completeness and ensure that no work change requests are issued without detailed scope of work, sketches/drawings, and the material take-off list.
  • Ensure timely evaluation and conclusion of the work change requests including issuing of variations to contracts (VTCs) after obtaining committeeu2019s approval.
  • Assume a lead role in dispute resolutions.
  • Ensure the close-out process is initiated by SD in a timely manner and assist SD in reviewing and issuing the completion certificates (CC), statement of final accounts (SFA), closeout report (COR), and discharge certificate (DC).
  • Evaluate with SD the contractor's performance at contract completion.
  • Post-contract: Claims and risk management:

  • Evaluate critically all claims raised by contractors and advise SD of the admissibility or otherwise of the same.
  • Apply change management and claims prevention expertise in the management of high-value contracts and administer claims management strategies in protecting client's commercial interests and thus balance the risk factor.
  • Review the existing process of claims management and dispute resolution, develop them for enhanced efficiency, productivity, and control, and provide advice on appropriate claims minimization strategies.
  • Participate in potential dispute defusing scenarios and in negotiating and drafting release agreements in consultation with legal.
  • Critically evaluate and challenge claims and extension of time issues - loss and expense claims from contractors in line with contract provisions and assist SD in seeking committeeu2019s approval for finalized claims and close out of contract.
  • Requirements:

  • BSc in engineering discipline or quantity surveying. However, a qualification in engineering discipline is preferred. A post-graduate qualification in contract management or project management is desirable.
  • 12 yearsu2019 experience in project execution in the oil and gas industry as a contract engineer, handling EPC and engineering contracts, from pre-award to post-award including management of claims.
  • Experience to include a minimum of 5 years in offshore engineering projects, of large and medium scale in complexity.
  • Possession of sound knowledge of contract law is desirable.
  • Proficient in contractual correspondence, contract variation, and report writing with analytical, logical, and problem-solving skills.
  • Fluent in English.
  • Thorough understanding of engineering, procurement, construction techniques EPC/EPIC/EPCM and LSTK, mainly related to offshore facilities such as process platforms, wellhead platforms, and submarine pipelines including brownfield modification on existing platforms.
  • Knowledge of other forms of contracts like FEED/ECS/construction/consultancy and related works/services.
  • Computer literate and able to use this knowledge for contract analysis, evaluation of statistical data both historical and projected.
  • Preferably experienced in managing contracts in SAP MM-ES and its day-to-day transactions and management.
