The key objectives for this role are:

  • Maximize commercial performance while managing business and project risk (pre and post-contract).
  • Commercialization of a sub-business group service offerings to support business growth and strategy.
  • Developing teams with in-depth commercial and cross-functional expertise to support the assigned business.
  • Ensure compliance with relevant commercial and contracting policies.
  • Resolution of disputes and claims and cash collection issues.
  • Embedding effective commercial governance and assurance across the sub-business group, project, and portfolio of projects.
  • Managing the tender governance process for the sub-business group.
  • Manage and provide team members with the general direction in commercial activities during the contract life cycle from input into tenders through contract delivery to contract commercial closeout.
  • Implement commercial strategy for the business unit within assigned project or sub-business group and ensure alignment of objectives to the business unit strategy and promote and demonstrate safety leadership behaviors.
  • Always act ethically and with the utmost integrity.
  • Champion and promote the application of the financial management framework guidelines.
  • Champion and follow the relevant DOA and commercial and contracting policies.

Responsibilities

  • Pre-award activities including support to the proposals team in terms of performing a commercial review of tender documents, reviewing commercial proposals prior to submission for internal approval, preparing pricing and commercial qualifications.
  • All activities within the tender governance processes across the sub-business group.
  • Compliance with commercial policies, processes, and procedures within sub-business group (tender governance, financial instruments, contracting policy, etc.).
  • Risk management process including risk identification, mitigation planning, and administration of risk process in conjunction with operations.
  • Contractual negotiation strategies for client contracts, joint ventures, and teaming agreements in conjunction with the bid team and key stakeholders.
  • Negotiation of terms and conditions with clients and suppliers.
  • Main contract administration across sub-business group including timely provision of commercial deliverables (e.g., bonds, performance guarantees, evidence of insurance), correspondence management, and management of change to optimize commercial entitlements.
  • Development, implementation, and maintenance of project commercial handover plans including commercial strategy, subcontracting commercial strategy, and profit improvement plans.
  • Regular project cost analysis and reviews to maximize recoverable costs, minimize disallowable costs, and ensure adequate cost accruals and provisions are in place.
  • DOA is maintained, communicated, and complied with across the sub-business group.
  • Project cash flow forecasts, expenditure, invoice preparation, and expediting of payments, with limited support and supervision, and in accordance with client contract requirements and company processes and procedures.
  • Ensuring the accuracy of invoices and supporting information and maintaining project invoice registers.
  • Developing subcontracting commercial strategy in conjunction with project management, supply chain, and other functions, as required.
  • The compilation of subcontract documents, including main contract flow downs, pricing, and payment prior to execution, subcontract filing and retention of records.
  • Regular cost analysis to maximize recoverable costs, minimize disallowable costs, identify areas for cost saving, and ensure adequate cost accruals and provisions are in place.
  • The preparation, delivery, and analysis of inputs to key contract and internal project reporting requirements and ensure the accuracy of project forecasts.
  • Commercial representation in monthly business unit, business group, and sub-business group project reviews.
  • The preparation and delivery of main contract and subcontract close-out requirements in full accordance with contract requirements while optimizing commercial recovery.
  • Governance and implementation of financial management framework within assigned project or sub-business group.
  • Align project or sub-business group specific commercial requirements with company commercial processes and procedures and communicate to relevant personnel.
  • Resource competent commercial personnel.
  • Manage and supervise personnel development and training of the designated commercial team.
  • Coordination of contract reviews and the development of qualifications and redlines in conjunction with the contracts function to ensure the balance of risk is appropriate for the associated services and remuneration model.

Expected:

  • Extensive project commercial management experience: 10-15 years of proven experience in commercial management of large-scale projects, ideally in engineering or construction-related industries.
  • Contractual knowledge: In-depth understanding of post-award contract management, including compensation models, risk mitigation, and change management.
  • Strategic communication: Strong communication skills, with the ability to influence, negotiate, and collaborate effectively across all levels of the organization.
  • Financial and analytical skills: Proficient in financial analysis related to project cash flow, profitability, and return on investment.
  • Organization and detail-oriented: Exceptionally organized, with a keen eye for detail and a methodical approach to managing tasks and coordinating resources.

Educational background

  • Preferred qualifications: Bachelor's degree in quantity surveying, engineering, business, or law.
  • Commercial experience requirement: Substantial experience in project commercial management (10-15 years) will be a key selection criterion, particularly in roles involving contract negotiation, project delivery, and financial management.
