Job description / Role
Job Objective:
Responsible for managing all contracts related items in the company, which includes evaluating bids from contractors as well as negotiating and awarding the contract to the winner. Reviews and finalized any outstanding claims or other issues that may arise from the contracts, it also includes processing and verifying requests for payment and releasing of final payments. The position provides a full range of contractual process such as contract preparation, contract negotiation, contract administration, closing-out of contracts and other contractual related activities of the company. The individual should possess an in-depth knowledge and working understanding of the standard contractual norms, its local and international requirements, specifications, procedures and policies.
Key Responsibilities:
1. Prepare, review and issue contractual agreements, its policies and procedures to facilitate contract terms. Develop strategies and recommendations of the contractual aspects of the proposed contract.
2. Participation in team meetings, preparing the terms and conditions of the contract, conduct contract analysis by reviewing the cost and price proposals as assigned in order to ensure that they are prepared and submitted in strict accordance with applicable rules and procedures, regulations, contractual provisions and company policy prior to submittal of the contract documents to the nominated contractors and consultant.
3. Perform all aspects of assigned contract including accuracy of contract funding, scope changes, contract amendments, receipts and delivery schedules, legal requirements and other commitments.
4. Prepare and issue subcontracting agreement, its modifications and other contractual related correspondence during prequalification or tendering stage and to facilitate meetings for the nominated committees.
5. Coordinating with other company functions as required by ensuring that appropriate reviews and submittals are scheduled and conducted and making sure that the required signature for approvals are obtained before the execution of contract documents.
6. Interpret contract requirements and provide expert advice and guidance on contractual conditions to involve personnel or Management to help improve future contract outcomes.
7. Coordinate with other departments as needed in order to meet the required contractual deadlines for that specific department.
8. Provide contract summaries and ensure contract execution is in accordance with company's policies and procedures.
9. Review contract documents, contractual terms and conditions and correspondence as part of the bid evaluation and subsequent proposal process.
10. Prepares and write proposals for new contracts as well as changes to existing contracts.
11. Able to identify and manage disputes, claims and performance deficiencies by resolving or minimizing the risk involved as they arises before it escalate into a major issue.
12. Develop and implement comprehensive contract management plans in accordance with the established contracts and approved procedures, monitors and analyze performance by addressing non-performing company in order to achieve the required contractual outcomes.
13. Maintaining integrity of contract information and to coordinate all aspects of the contract administration process in accordance with the approved Contractual Procedures in order to meet the company's need.
14. Prepare Bid Invitations, control the issuance of RFP's / RFA's / drawings etc. and keeping records of variation orders. Also disseminate information to concerned parties regarding contract status.
15. Provide contract summaries and ensure contract execution is in accordance with company's policies and procedures.
16. Develop positive and collaborative relationships with internal / external suppliers that will result to an effective and constructive challenge and support, thereby ensuring that the desired outcomes are met.
17. Tender, review the terms of the Property Insurances, negotiate and appoint suitable Insurance Provider. Manage and control all Property Insurances for various projects of RAK Properties.
18. Tender, review the terms of all Service Contracts for Facility Team and appoint suitable Insurance Provider.
19. Update the Contracts Procedures Manual from time to time, in line with the Board Approvals, Auditor’s recommendations / findings, etc. Also, update various Formats included in the Contracts Procedure Manual.
20. Ensure compliance with the company’s policies, rules and procedures related to Health, Safety and Environmental Management.
21. To do any additional tasks assigned by the line manager or department head.
Requirements:
Bachelor's degree in Civil Engineering or Quantity Surveying or related discipline.
Minimum 8-10 years of work experience on the client-side in Real Estate or Civil construction sector in UAE/GCC.
Must have hands-on and strong experience in pre-contract activities, particularly in tender invitation, tender review, tender evaluation, LOA, preparing contract agreement, procurement of contractors & consultants etc.
