JOB TITLE: Principal Engineer - Contracts

KEY RESPONSIBILITIES:

Assist/Manage all activities related to post award on contractual, legal and commercial issues related to:

- Contracts with Clients.
- Subcontracts and Procurement.
- Joint Venture and partnering agreements.
- Risk and Opportunity review process including, identification, mitigation and management of commercial/contractual/legal risks.
- Contract variations and claims.
Primary Duties

- Supports and manages all activities related to administration of assigned contracts including correspondence with clients and partners, provision of commercial / contractual inputs for project review meetings, liaison with engineering, project, site, subcontracts and procurement teams to identify potential variations and claims, preparation and submission of variations and claims, risk identification, risk mitigation risk management during the post award stage.
- Perform contract lifecycle management in accordance with company processes and procedures.
- Develop project-specific special terms and conditions for subcontracting and procurement.
- Provide support to Subcontracts and Procurement for negotiating terms and conditions of downstream contracts.
- Liaise with Insurance for the issuance of project insurance certificates to Clients and for submission of claims to insurer.
- Liaise with Treasury for issuance of performance bank guarantees to Clients.
- Liaise with Legal to prepare legal/contractual positions on disputed claims and variations with Clients / Subcontractors / Vendors.
- Support the Commercial Director in the negotiation of variations and claims with Client. Assist the Commercial Director and project / commercial team members in compiling supporting documents for potential claims, preparing advance defense for issues that are likely to evolve during execution phase.
- Assist, evaluate and advise Commercial Director on contractual conflicts and claims with clients. In the event of a dispute, advise on the company's position, information required in defense of or in pursuance of such.
- To review on a regular basis, company's position after evaluating reports received from the project team in respect of discrepancies, anomalies, risk and opportunities and take necessary action.
- Assist in managing all activities related to contractual, legal, tax, commercial and insurance issues related to company business, contracts with clients and partnering agreements during the post award stage.
- Maintain commercial / contractual database in accordance with company procedures and processes.
- Assist in ensuring that the key contract terms and conditions are presented and understood by the Project Management and Commercial Team upon award of the Contract.

Requirements

ESSENTIAL QUALIFICATIONS AND SKILLS:

- A graduate university degree in Engineering or Business Administration.
- Experience in tendering, finalization, administration and management of Contracts and in finalization of various Partnership Agreements.
